The current litigation between Balboa Instruments and Gecko Electronique and the tirades of accusations, explanations and statements and the campaign of misinformation and disinformation have caused an unhealthy business atmosphere to prevail in our industry. Competition is being stifled and the industry has been thrown in a quandary and a tizzy of uncertainty.
This state of ambiguity and instability has caused our business to suffer - we and our industry are paying the price of negative promotion. At Applied Computer Controls, we feel It is therefore incumbent upon us to clearly state our position and standing to our clients in particular and to the spa industry in general :
Applied Computer Controls have been subpoenaed by the court to testify and to produce relevant evidence in the Balboa vs. Gecko litigation - We are not a party to the litigation. Applied Computer Controls has never been the subject of any patent or infringement law suit. Both Balboa Instruments and Gecko Electronique have sought our help in their respective litigation(s). Balboa Instruments requested our help for their litigation with Siege Industries. Gecko Electronique requested our help for their litigation with Balboa Instruments. After Balboa's successful injunction against Gecko Electronique and in order to comply with the court ordered injunction Gecko "retooled" their products to emulate our 1982 SC-100 and SC-200 products.
Gecko is enjoined from displaying the letters "FLO" (among others) as an indication of water flow problem(s). Typically Balboa and/or Gecko packs use a pressure switch rather than a flow switch. It is ironic that both combatants use a nomenclature that is a misrepresentation of the state of their controls. On the other hand, and because ACC designs are original, our SmarTouch Digital controls display the codes "PSOL", "PSOH" and "PSOC" to indicate a Pressure Switch Open with the Low pump or with the High pump, or with the Circulating pump. Besides indicating an error condition, our implementation serves the purpose of diagnosing whether a pressure switch is inoperative or simply out of adjustment.
The purpose of this page is to make a statement of position rather than to point fingers of accusation. When all is said and done, only the lawyers will be laughing and our industry would have been set back. Let the free market forces and the rules of competition be the deciding factors.
